Terms & Conditions – The SMM Dude

These Terms & Conditions (“Terms”, “Agreement”) constitute a legally binding contract between you (“User”, “Customer”, “you”, “your”) and The SMM Dude, operating and accessible at https://thesmmdude.com (“Platform”, “Website”, “Service”, “we”, “us”, “our”).

By accessing the Platform, registering an account, adding funds, initiating a payment, placing an order, or using any service provided by The SMM Dude, you expressly acknowledge, confirm, and agree that you have read, understood, and accepted these Terms in full, including all incorporated policies and applicable laws.
If you do not agree to these Terms, you must immediately discontinue use of the Platform.


1. Legal Capacity & Eligibility


a. You confirm that you are at least 18 years of age or the legal age of majority in your jurisdiction.
b. You confirm that you possess the legal capacity and authority to enter into binding contracts.
c. You represent that your use of the Platform is strictly for lawful purposes.
d. The Platform is not intended for minors, and any account found to be operated by or on behalf of a minor shall be permanently terminated without notice and without entitlement to refunds, credits, or compensation.


2. Binding Agreement & Electronic Acceptance


a. By registering, depositing funds, or placing an order, you enter into a legally binding electronic agreement with The SMM Dude.
b. You expressly provide valid digital and click-wrap consent.
c. You consent to the use of electronic records, logs, invoices, confirmations, and communications as legally valid evidence.
d. You waive any claim based on ignorance, misunderstanding, or failure to read these Terms.
e. Continued use of the Platform constitutes ongoing acceptance of any updates or revisions.


3. Nature of Business & Service Classification


a. The SMM Dude operates strictly as a digital service reseller and intermediary.
b. We do not own, operate, manage, control, or have affiliation with any social media platform.
c. All services are sourced from independent third-party providers.
d. All services are intangible, digitally delivered, non-physical, and non-returnable once initiated.
e. Payments are made for service access, processing, and allocation, not for guaranteed outcomes.
f. Results may vary due to algorithm changes, platform policies, account behavior, content quality, or external technical factors.
g. All services are provided solely for promotional and appearance-enhancement purposes.


4. User Acknowledgement of Risk


a. You acknowledge that social media platforms may change rules, algorithms, or enforcement policies without notice.
b. You understand that engagement metrics may fluctuate, drop, delay, or partially complete.
c. You accept that no service can override platform terms, safeguards, or detection systems.
d. You knowingly accept all risks associated with the use of digital promotional services.


5. Account Responsibility & User Obligations


a. You are solely responsible for maintaining the confidentiality of your account credentials.
b. You are responsible for all activity conducted under your account, whether authorized or unauthorized.
c. You must ensure that all order details, usernames, links, and content are accurate and valid.
d. You must ensure that target accounts, posts, profiles, or channels are public and eligible at the time of order.
e. Any loss caused by incorrect input, private or restricted accounts, deleted content, username changes, or link changes is entirely your responsibility.


6. Active Order Restrictions & Interference Disclaimer


a. During any active or processing service order, you must refrain from altering, editing, deleting, or changing the link, post, username, channel, group, or profile associated with the order.
b. During an active order, you must not place the same link, post, or profile on any other SMM panel, service provider, or automation system.
c. Any interference, modification, overlap, or third-party usage during an active order may and will cause discrepancies in delivery metrics.
d. In such cases, The SMM Dude shall not be liable for refunds, refills, reorders, compensation, or adjustments under any circumstances.


7. Telegram Channel Member Services – Mandatory Private Invite Links


a. For Telegram channel member services, users must always use private invite links.
b. Public Telegram channel links are strictly excluded from refill, refund, or reorder eligibility for member-based services.
c. Drops, discrepancies, or losses arising from the use of public links are entirely the user’s responsibility.
d. By placing such orders, you acknowledge and accept that no compensation shall be provided for public-link-based Telegram member services.


8. Payments, Wallet System & Transaction Finality


a. All payments are prepaid and credited to an internal wallet system.
b. Wallet balances are non-transferable, non-withdrawable, and non-reversible.
c. Deposits are final and irreversible once credited.
d. Prices may change at any time without prior notice.
e. Wallet credit represents prepaid digital service value and does not constitute stored money, bank balance, or financial deposit.


9. Explicit No-Chargeback, No-Dispute & Abuse Clause


a. By making any payment, you expressly agree not to file chargebacks, disputes, reversals, or payment claims.
b. You waive all dispute rights based on dissatisfaction, delay, drops, or platform behavior.
c. Any dispute constitutes a breach of contract and fraudulent misuse of payment systems.
d. Consequences include immediate account termination, permanent platform ban, forfeiture of wallet balance, and submission of evidence to payment gateways and banks.


10. Digital Service Finality & Instant Processing Acknowledgement


a. You acknowledge that services are digitally delivered and may begin instantly or automatically.
b. Once a service is initiated, it cannot be recalled, reversed, or cancelled.
c. You therefore waive all rights to refunds, reversals, or payment disputes after service initiation.


11. Limited Discretionary Adjustments


a. Any credits, refills, or adjustments are granted solely at the discretion of The SMM Dude.
b. Such actions do not imply fault, liability, or obligation.
c. Issued adjustments do not establish precedent.
d. Once an adjustment is made, the matter is deemed fully resolved.


12. Refill, Stability & Fair-Use Disclaimer


a. Refills apply only where explicitly stated on the service page.
b. Stability is not guaranteed.
c. Drops caused by platform updates, spam actions, enforcement, or user behavior are excluded.
d. Use of multiple panels voids all refill and guarantee claims.


13. Prohibited Conduct & Fraud Prevention


a. Use of stolen, unauthorized, or fraudulent payment methods is strictly prohibited.
b. Abuse of payment gateways, processors, or dispute systems is prohibited.
c. Attempts to exploit system loopholes or automation vulnerabilities are prohibited.
d. Violations may result in termination, reporting to processors, and legal action.


14. Shipping & Delivery Policy (Digital Services)


a. The SMM Dude provides online digital services only.
b. No physical shipping or delivery exists.
c. Delivery timelines are estimates and not guarantees.


15. Refund Policy (Integrated & Gateway-Compliant)


a. Refunds are not automatic and require manual review.
b. Default refunds, if approved, are issued as internal wallet credits.
c. Gateway and network fees are non-refundable.
d. External refunds are considered only if requested within two hours, no service has initiated, wallet is unused, and payment is verified.
e. Maximum refundable amount is capped at seventy-five percent of the credited value.
f. Processing time is an estimate of seven to nine business days.
g. No refunds are provided for dissatisfaction, drops, delays, or third-party failures.
h. Cryptocurrency payments are subject to volatility and irreversible blockchain fees.


16. Disclaimer of Warranties


a. The Service is provided strictly “as-is” and “as-available” without warranties of any kind.


17. Limitation of Liability


a. To the maximum extent permitted by law, The SMM Dude shall not be liable for financial loss, business damage, account penalties, reputational harm, or indirect or consequential damages.
b. Your sole remedy is discontinuation of the Service.


18. Privacy & Data Handling


a. Only necessary data is collected for service delivery, security, and compliance.
b. Personal data is not sold.
c. Payments are processed exclusively through third-party gateways.


19. Compliance, Audit & Record Retention


a. Transaction logs and consent records are retained for audit and compliance purposes.
b. Fraud monitoring systems are actively maintained.
c. Evidence may be shared with payment processors and authorities upon request.


20. Governing Law & Jurisdiction


a. These Terms are governed by the laws of India.
b. Exclusive jurisdiction lies with the courts of India.
